MemeDance Terms of Service

1. Acceptance of Terms

Please read these Terms of Service ("Terms") carefully. To access and use MemeDance (the "Service"), you must agree to these Terms. If you do not agree to these Terms, you shall not use the Service. By creating an account or clicking "Sign Up," you expressly acknowledge and agree to be bound by these Terms.

2. Eligibility

• Age Requirement: You represent and warrant that you are at least 18 years of age (or the age of legal majority in your jurisdiction).
  Exception: If you are a minor aged 14 or older but under the age of majority, you represent that you have obtained the explicit consent of your parent or legal guardian to use the Service and agree to these Terms.
• Strict Prohibition: Users under the age of 14 are strictly prohibited from using the Service.
• Prohibited Users: We reserve the right to refuse service to anyone for any reason at any time, specifically including previous violators of our Terms.

3. Service Usage & Credits

• Credit System: Our Service operates on a credit-based system. Detailed rules regarding credit expiration, consumption priority, and validity are governed by our Credit Policy.
• Abusive Behavior: Any form of abusive behavior intended to obtain unfair advantages is strictly prohibited. This includes, but is not limited to, the exploitation of system vulnerabilities (bugs), manipulation of credit distribution mechanics, or the use of automated scripts to farm credits. We reserve the right to immediately suspend such accounts and revoke any illegitimate gains without notice.
• Refunds: All purchases are subject to our Refund Policy.
• Fraud Prevention Measures: To protect our service from credit farming and abuse, we reserve the right to actively block connections from known VPNs, proxies, and disposable email providers. We may require additional verification if suspicious activity is detected.

4. User Conduct (Prohibited Activities)

You agree NOT to use the Service to upload, generate, or share content that includes:

• Non-Consensual Content: Photos of individuals without their explicit consent (Deepfakes).
• Public Figures: Content depicting politicians, celebrities, or public figures in a defamatory or misleading manner.
• NSFW & Illegal Content: Nudity, pornography, sexual acts, excessive violence, self-harm, or hate speech.
• Copyright Infringement: Photos or materials that you do not have the right to use.

5. Intellectual Property Rights

• Your Input: You retain full ownership of the images/videos you upload. By uploading, you grant us a limited, non-exclusive license to process the image solely for the purpose of generating your requested content.
• Your Output: You own the rights to the AI-generated images/videos created using your account. You may use them for personal or commercial purposes, subject to local laws.
• Platform Rights: The Service interface, AI inference logic, proprietary code, and branding remain the exclusive property of MemeDance.

6. Account Deletion and Re-registration Ban

• Account Deletion: You may delete your account at any time through the app settings. Upon deletion, all remaining credits (both paid and free), generated content, and associated data will be permanently erased and cannot be recovered.
• 30-Day Re-registration Ban: To prevent fraudulent activities, you will be restricted from re-registering with the same email address or social account for a period of 30 days following account deletion.

7. AI Disclaimers & Limitations

• No Guarantee of Quality: AI generation is probabilistic. The output may contain artifacts, distortions (e.g., extra limbs), or unexpected movements. We do not guarantee that the result will be flawless or meet your aesthetic expectations.
• Service Availability: We may temporarily suspend the Service for maintenance or updates. We are not liable for any loss of data or credits during such outages, though we will strive to restore them.

8. Privacy & Data Retention

Your use of the Service is also governed by our Privacy Policy.

• Source Data Deletion: To protect your privacy, original photos uploaded for generation are automatically deleted from our servers after a short period (typically 72 hours), unless otherwise stated.

9. Termination

We may terminate or suspend your access to the Service immediately if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

10. Modification and Termination of Service

• Right to Terminate: We reserve the right to modify, suspend, or completely discontinue the Service (or any part thereof) at any time for business, technical, or operational reasons.
• Prior Notice: In the event of a complete permanent shutdown of the Service, we will provide at least 30 days' advance notice via our website, app, or email to allow users time to consume their remaining credits.
• Handling of Credits upon Shutdown: Upon the effective date of the Service termination, all promotional, bonus, or free credits, as well as generated content, will immediately expire and be permanently deleted without any compensation. Any wholly unused Paid Credits remaining in your account will be subject to a refund process in accordance with applicable laws and our Refund Policy.

11. Indemnification

You agree to indemnify, defend, and hold harmless MemeDance, its affiliates, and its employees from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your use of the Service;
• The Content (Input and Output) you upload or generate, including claims of copyright infringement, defamation, or unauthorized use of a person's likeness (including, but not limited to, Deepfakes);
• Your violation of these Terms or any applicable law.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of laws principles.

Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the Seoul Central District Court (or the competent court of MemeDance's registered operating address in Korea).

Notwithstanding the foregoing, nothing in these Terms shall deprive consumers of the protection afforded to them by mandatory provisions of the laws of their country of residence.
