MemeDance Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern the rights, obligations and responsibilities of the Company and users when using MemeDance (the "Service"). If you do not agree to these Terms, you may not use the Service. By creating an account or using the Service, you expressly agree to be bound by these Terms.

2. Eligibility

• Age Requirement: You must be at least 14 years of age.
  Minors aged 14 or older may use the Service only with the explicit consent of a parent or legal guardian.
• Strict Prohibition: Users under the age of 14 are strictly prohibited from using the Service.
• Prohibited Users: We reserve the right to refuse re-registration by users who have previously violated our Terms.

3. Service Usage & Credits

• Credit System: Purchased credits and rewards appear in one balance and can be used for the same generation features. Each grant's expiration, consumption priority and other rules are governed by our Credit Policy.
• Abusive Behavior: Any form of abuse intended to obtain unfair advantages, including exploiting system bugs or farming credits through multiple accounts, is strictly prohibited. As a rule, we may suspend an account after prior notice. In urgent cases involving violations of applicable law or serious harm to the company, we may act first, including permanently suspending the account and confiscating improperly obtained credits, and notify the user afterward.
• Refunds: All purchases are subject to our Refund Policy.

4. User Conduct (Prohibited Activities)

You must not generate or upload content that includes:

• Non-Consensual Content: Deepfake content created without the consent of the person concerned.
• Public Figures: Content depicting politicians, celebrities, or public figures in a defamatory or misleading manner.
• NSFW & Illegal Content: Nudity, pornography, excessive violence, self-harm, or hate speech.
• Copyright Infringement: Photos or materials that you do not have the right to use.

5. Intellectual Property Rights

• Your Input: You retain ownership of the media you upload. You grant the Company a non-exclusive license to the extent necessary to provide the Service.
• Your Output: You own the rights to the AI-generated images/videos created using your account. You may use them for personal or commercial purposes, subject to local laws.
• Platform Rights: The Service interface, AI inference logic, proprietary code, and branding remain the exclusive property of MemeDance.

6. Account Deletion and Re-registration Ban

• Account Deletion: You may request account deletion at any time through the Service settings or customer support. Upon deletion, all remaining credits, generated content, and associated data will be permanently erased and cannot be recovered.
• 30-Day Re-registration Ban: To prevent fraudulent activities, you will be restricted from re-registering with the same email address or social account for a period of 30 days following account deletion.

7. AI Disclaimers & Limitations

• No Guarantee of Quality: AI generation is probabilistic. The output may contain artifacts, distortions (e.g., extra limbs), or unexpected movements. We do not guarantee that the result will be flawless or meet your aesthetic expectations.
• Service Availability: The Service may be temporarily suspended for maintenance or similar reasons. We are not liable for resulting data loss unless caused by our intentional misconduct or gross negligence.

8. Privacy & Data Retention

Your personal information is protected in accordance with our Privacy Policy.

• Source Data Deletion: To protect your privacy, uploaded media files are automatically deleted from our servers within a short period (typically 72 hours) after the generation task is completed.

9. Termination

We may terminate or suspend your access to the Service immediately if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

10. Modification and Termination of Service

• Right to Terminate: We may discontinue the Service entirely for reasonable grounds, including business circumstances, declining profitability or technical limitations.
• Prior Notice: If the Service is discontinued, we will provide at least 30 days' advance notice through in-service notices and notification channels.
• Handling of Credits upon Shutdown: Upon the effective date of the Service termination, all credits granted as rewards, promotions or purchase bonuses, as well as generated content, will immediately expire and be permanently deleted without any compensation. Unused credits that you purchased directly and still hold will be subject to a refund process in accordance with applicable laws.

11. Indemnification

You agree to indemnify and hold harmless MemeDance, its affiliates, and its officers and employees against all claims, liabilities, damages, losses or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service;
• The Content (Input and Output) you upload or generate, including claims of copyright infringement, defamation, or unauthorized use of a person's likeness (including, but not limited to, Deepfakes);
• Your violation of these Terms or any applicable law.

12. Governing Law and Jurisdiction

These Terms shall be construed in accordance with the laws of the Republic of Korea.

Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the Seoul Central District Court. However, if the consumer's address or residence is clear at the time the action is filed, the exclusive jurisdiction of the district court under Article 36 of the Korean Act on the Consumer Protection in Electronic Commerce, etc. shall take precedence.

Notwithstanding the foregoing, nothing in these Terms shall deprive consumers of the protection afforded to them by mandatory provisions of the laws of their country of residence.
